GENERAL TERMS AND CONDITIONS OF SALE (GTCS)

PREAMBLE
Pain d'Antan SA and its associated companies (hereinafter collectively referred to as “Le Pain d'Antan” or “the Seller”) offer artisanal products for sale in the sectors of bakery, pastry, chocolate-making, ice cream and catering. As these products are perishable, made to order and subject to constraints inherent to artisanal production, these General Terms and Conditions of Sale define the rights and obligations of the parties with all required clarity.
The customer is expressly invited to read these GTCS carefully before any order or purchase. Any order or purchase constitutes full and unconditional acceptance of these terms.
Article 1 — Scope of application
These GTCS apply to all product sales made:
• at points of sale operated under the brands Le Pain d'Antan, Nazhia, Lacheba and Tombar;
• via the website www.lepaindantan.be (hereinafter “the Website”).
They apply to all products offered for sale, whether in-store or online. Any order or purchase implies the customer's full and unconditional agreement to these GTCS, which take precedence over any other document issued by the customer.

These companies jointly conduct their activities under the Le Pain d'Antan brand and share the same general terms and conditions of sale. Le Pain d'Antan SA is the company responsible for the Website and the processing of online orders.
Article 3 — Product description
3.1 Artisanal nature and accepted variations
The products offered are artisanal preparations: breads, pastries, cakes, chocolates, ice creams, desserts, sandwiches, catering products, beverages, etc. Due to their artisanal production, the natural evolution of recipes, seasons and supply conditions, slight variations may occur in the composition, appearance, colour, shape or weight of the products.
These variations are an inherent and accepted characteristic of artisanal products. They shall in no way constitute a lack of conformity or grounds for complaint, as long as they do not affect the essential qualities of the product.
3.2 Value of visuals and descriptions
Images, photographs, illustrations and descriptions appearing on the Website, menus, packaging, promotional materials or any other communication medium are provided for indicative purposes only and have no contractual value.
The customer expressly acknowledges that the visuals presented may differ from the products delivered or collected, particularly in terms of presentation, decoration, size or colour, without this engaging the Seller's liability.
3.3 Allergens and nutritional information
Information on allergens is available in-store upon request or on the Website. It is the customer's responsibility to check the composition of products before purchase, particularly in the case of an allergy or food intolerance. Le Pain d'Antan shall not be held responsible for the consequences of consumption by a customer with an allergy or intolerance who has not carried out this verification.
Article 4 — Online orders
4.1 Ordering process
The customer selects products on the Website, chooses the collection location and date, then confirms their order after accepting these GTCS. The order is confirmed by email following payment validation, which constitutes the formation of the sales contract. Le Pain d'Antan reserves the right to refuse or cancel any order in the event of a manifest anomaly, out-of-stock situation or suspicion of fraud.
4.2 Product availability
Products are offered subject to available stock. In the event of total or partial unavailability after order confirmation, Le Pain d'Antan will inform the customer as soon as possible and offer either a substitute product of equivalent quality and value, or a full refund of the corresponding amount. The customer is free to accept or decline the substitute product.
4.3 Order modification or cancellation
As products are specifically made to order and are perishable in nature, no modification or cancellation can be accepted by the customer after the order has been validated and paid for, in accordance with Article VI.53 of the Belgian Code of Economic Law (CEL). Any exceptional cancellation request must be sent as soon as possible to contact@lepaindantan.be. The Seller will assess such requests at its sole discretion.
Article 5 — In-store collection
Products ordered online must be collected at the chosen point of sale, on the date and at the time agreed upon when placing the order. The customer acknowledges having been informed that:
• products are specifically prepared for them on the scheduled date;
• failure to collect on the agreed date and time results in the definitive loss of the product, with no possibility of refund, given the perishable nature of the items;
• no holding period or deferral of collection can be guaranteed, except with the Seller's prior express agreement.
Article 6 — Prices
Prices are stated in euros (€), inclusive of all taxes (VAT included), in accordance with Belgian regulations. Le Pain d'Antan reserves the right to modify its prices at any time without prior notice. Products are invoiced at the price in effect at the time of order validation. In the event of a manifest pricing error, Le Pain d'Antan reserves the right to cancel the order concerned and inform the customer accordingly.
Article 7 — Payment
Payments are made:
• online via the secure solutions offered on the Website (Bancontact, bank card, etc.);
• in-store in cash, by bank card or any other means of payment accepted by the establishment.
An order is only considered definitively validated upon receipt of full payment. Le Pain d'Antan shall not be held responsible for any malfunction of a third-party payment platform.
Article 8 — Right of withdrawal
In accordance with Article VI.53, 4° of the Belgian Code of Economic Law, the right of withdrawal is expressly excluded for goods liable to deteriorate or expire rapidly, in particular fresh and artisanal food products.
By ordering on the Website, the customer expressly acknowledges that the ordered products fall within this exception and waives any right of withdrawal. Consequently, no confirmed and paid order may be cancelled or refunded solely on the grounds of a change of mind on the part of the customer.
Article 9 — Conformity and complaints
9.1 Verification upon collection
The customer is required to check the condition of products at the time of collection. Any apparent anomaly (missing product, order error, product visibly unfit for consumption) must be reported immediately to in-store staff or by email to contact@lepaindantan.be.
9.2 Complaint deadline
Any complaint relating to the quality, conformity or error of a product must be submitted within a maximum period of 24 hours following collection or receipt. After this deadline, no complaint can be accepted, as the perishable nature of the products makes it impossible to verify their condition.
9.3 Handling of complaints
Any admissible complaint will be processed as quickly as possible. Le Pain d'Antan reserves the right to request any useful supporting document (photo of the product, proof of purchase). In the event of a well-founded complaint, the Seller will offer, depending on the circumstances and at its discretion:
• a product exchange;
• a credit note towards a future order;
• a commercial gesture.
No cash refund will be granted beyond the cases expressly provided for by law or in the event of proven fault by the Seller.
Article 10 — Liability
10.1 Exclusions of liability
Le Pain d'Antan cannot be held liable for direct or indirect damages resulting from:
• improper storage, handling or consumption of products after collection;
• an allergy or intolerance not previously disclosed;
• use of products contrary to their intended purpose;
• unavailability or interruption of the Website for technical reasons beyond the Seller's control.
10.2 Limitation of liability
In all cases where the liability of Le Pain d'Antan is established, it is expressly limited to the VAT-inclusive amount of the order concerned. Le Pain d'Antan cannot be held liable for indirect, intangible or consequential damages.
Article 11 — Intellectual property
All elements of the Website (texts, visuals, logos, recipes, photographs, graphic charters, trade names, etc.) are protected by copyright and intellectual property rights. They remain the exclusive property of Le Pain d'Antan SA or its partners. Any reproduction, representation, use, adaptation or exploitation, in whole or in part, by any means and for any purpose whatsoever, without prior written authorisation, is strictly prohibited and constitutes an infringement.
Article 12 — Personal data protection
Personal data collected via the Website is processed by Le Pain d'Antan SA as data controller, in accordance with Regulation (EU) 2016/679 (GDPR) and the Belgian law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data.
The customer has the following rights:
• right of access, rectification, erasure, restriction and portability of their data;
• right to object to processing;
• right to lodge a complaint with the Belgian Data Protection Authority (DPA).

Article 13 — Force majeure
Le Pain d'Antan shall not be held responsible for a failure or delay in the performance of its obligations in the event of a force majeure event within the meaning of Article 1.8.1. of the Belgian Civil Code, including: strike, fire, flooding, computer failure, pandemic, supply disruption, administrative decision or any other unforeseeable, irresistible and external event. In the event of force majeure, Le Pain d'Antan will inform the customer as soon as possible and endeavour to find an alternative solution.
Article 14 — Dispute resolution and mediation
In the event of a dispute, the customer is invited to contact the customer service department first at contact@lepaindantan.be in order to seek an amicable solution. In accordance with applicable regulations, the consumer customer may also resort to an out-of-court mediation procedure via the Consumer Mediation Service (https://mediationconsommateur.be) or any other competent out-of-court dispute resolution (ODR) body.
Article 15 — Applicable law and jurisdiction
These GTCS are governed by Belgian law. In the event of a dispute that cannot be resolved amicably, the courts of the judicial district of Namur shall have sole jurisdiction, except for any mandatory statutory provisions applicable to consumers (in particular the possibility for the consumer to bring proceedings before the court of their place of residence).
Article 16 — Severability
If any clause of these GTCS is declared null or unenforceable by a court decision, the remaining clauses shall remain in full force and effect. The null clause shall be replaced, as far as possible, by a valid clause that reflects the original intention of the parties.
Article 17 — Acceptance of the GTCS
The customer declares having read these General Terms and Conditions of Sale and accepts them fully and without reservation. For online orders, this acceptance is materialised by clicking the validation button during the ordering process. In-store, any purchase constitutes tacit acceptance of these GTCS.
